Learned counsel for the petitioner is present, but none appears on behalf of opposite party in spite of valid service of notice deemed to be validly served. 2. Instant transfer petition has been preferred for transfer of Original Suit No. 630 of 2023 from the Court of learned Principal Judge, Family Court, Bokaro to the Court of learned Principal Judge, Family Court, at Ranchi. It is submitted that petitioner’s husband i.e. opposite party has filed Original Suit No. 630 of 2023 under Section 12(1)(c), 12(d) of Hindu Marriage Act for decree of nullity annulling the marriage. 3. Learned counsel for the petitioner has submitted that the petitioner is the legally married wife of the opposite party. Due to domestic dispute, cruel treatment and torture at the hand of the opposite party (husband) she has started residing at her parental home and also instituted complaint case No. 8063 of 2024 dated 21.08.2023 for the offence under Section 498 A of the I.P.C. and also filed original maintenance Case no. 369 of 2023 dated 18.08.2023 before the learned Principal Judge, Family Court, Ranchi which are also pending for adjudication. It is further submitted that after institution of the aforesaid cases and the opposite party after coming to know about the pending above cases, instead of appearing in the 2025:JHHC:26474 said cases has filed two cases one under Sections 12 of Hindu Marriage Act for annulment of marriage in Original Suit No. 630 of 2023 before learned Principal Judge, Family Court, Bokaro and another a complaint case no. 1550 of 2023 before the learned Judicial Magistrate, Bokaro with a view to harass the petitioner. The petitioner having no source of income, is unable to attend and participate the proceeding before court situated at Bokaro. She has also not been provided any maintenance by her husband (opposite party). Therefore, it is impossible for her to prosecute the aforesaid cases by physically attending before the court at Bokaro. 4. Considering the contentions raised on behalf of the petitioner, I feel inclined, in the ends of justice, to allow the prayer for the petitioner. 5. Accordingly, the proceeding of Original Suit No. 360 of 2023, pending before the Court of learned Principal Judge, Family Court, Bokaro is hereby, transferred to the Court of learned Principal Judge, Family Court, Ranchi. 6.
