1. The instant petition has been filed for seeking a direction towards the respondent No.3 to release the remaining compensation amount awarded to the petitioner in the land acquisition proceedings in respect of project i.e. Rail Corridor Project (Urga to Dharamjaigarh), where the house of the petitioner over the land bearing Khasra No.206/1 situated at Village Dongaama, Tahsil Kartala, District Korba, C.G. was acquired.
2. The grievance of the petitioner is that the land of the petitioner was acquired in the land acquisition proceedings in respect of project i.e. Rail Corridor Project (Urga to Dharamjaigarh) bearing Khasra No.206/1 situated at Village Dongaama, Tahsil Kartala, District Korba and in the Land Acquisition Case No.21/A-82/2019-20 was initiated in which award was passed on 23/07/2020 and thereafter notice was sent to the petitioner to collect the compensation amount of Rs.22,60,948/- towards compensation and Rs.5.00 Lakhs towards rehabilitation but subsequently the petitioner was paid with Rs.16,49,532/- out of total compensation amount and thus till date remaining compensation amount of Rs.6,11,416/- towards compensation and Rs.5.00 Lakhs towards rehabilitation has not been disbursed to the petitioner. Hence this petition.
3.
Learned counsel for the petitioner would submit that despite passing of the award the remaining compensation amount of Rs.11,11, 416/- has not been disbursed.
4. Learned State counsel submits that they have no objection in
3 / 3 granting the undisputed amount to the petitioner.
5. I have heard learned counsel for the parties and perused the documents.
6. Considering the facts and circumstances of the case, it is directed that the respondent authorities shall deposit the undisputed amount of Rs.6,11,416/- towards the compensation except the amount of Rs.5,00,000/- (towards rehabilitation) as the same is pending
consideration, within a period of 30 days from the date of receipt of copy of this order, subject to verification of the documents.
