17/06.05.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 438 and 440 of the Code of Criminal Procedure, as the petitioner has been allegedly implicated in connection with Chandankiyari PS case no. 68 of 2010, corresponding to G.R. No.528 of 2010 registered for the offences punishable under sections 379, 411, 34 of the Indian Penal Code, pending in the court of learned Judicial Magistrate, 1st Class, Bokaro.
Heard the learned counsel for the petitioner, learned counsel appearing on behalf of the State.
The learned APP opposes the prayer for anticipatory bail of the petitioner.
There is an allegation of illegal transportation of coal and it is alleged that one factory is the beneficiary of that said coal of which petitioner is said to be the owner but he denies the ownership.
The glaring aspect in this case is that the FIR is lodged on 15.04.2010 but till date charge-sheet has not been submitted.
Learned counsel for the petitioner submits that since the Investigating Officer is trying to arrest the petitioner, which forced him to approach this Court by filing this anticipatory bail application. He further submits that during the major period of this time, there was an interim order in favour of the petitioner in a quashing application.
Since the offence is under Section 379, 411, 34 of the Indian Penal Code and for the last 15 years the charge-sheet has not been filed by the Investigating Officer against the petitioner, I am inclined to release the petitioner on anticipatory bail. Accordingly, the petitioner, above named, is directed to

surrender before the court below within four weeks from today and in the event of his surrender/arrest the learned court below is directed to enlarge him on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned judicial Magistrate, 1st Class, Bokaro, in connection with Chandankiyari PS case no. 68 of 2010, corresponding to G.R. No.528 of 2010, subject to the condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/ her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the learned trial court indicating his /her share in the property. Petitioner is directed to cooperate with the investigation and will appear before the Investigating officer once in a week till final report is filed.
