Date : 17/06/2025 ORAL ORDER By way of present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (for short “CrPC”), the petitioner has sought quashing and setting aside of the communications by which the application of the petitioner for renewal of the passport of the petitioner as prayed in application dated 12.04.2024 has been rejected. Perusing the record it appears that offence being I-CR No.08/2015 was registered against the petitioner with Surendranagar City ‘B’ Division Police Station in connection with which petitioner was granted anticipatory bail in the proceedings of Criminal Misc. Application No.48/2015 wherein condition was imposed by which the petitioner was directed to surrender his passport and in compliance of the same, petitioner surrendered his passport however, the said condition came to be deleted and thereafter, the petitioner approached this Court by way of filing
R/SCR.A/5884/2025 ORDER DATED: 17/06/2025 Special Criminal Application No.1801/2015 wherein proceeding came to be stayed. As the petitioner is having the passport and wants to get renew his passport, he approached the learned trial Court however, the learned trial Court dismiss the said application due to pendency of SCR.A No.1801/2015. Hence, petitioner has filed the present petition. Having heard the learned advocates for the respective parties, it appears that as such today no proceeding is pending against the petitioner and mere renewal of passport is not going to prejudice the prosecution and/or is not going to adversely affect any right of either of the parties. In view of the above, present petition is allowed. The respondent No.2 is directed to renew the passport of the petitioner for a period of 10 years.
