The present Writ Petition is filed questioning the action of the Respondents in not paying the contract bill to an amount of Rs.17,60,000/- to the petitioner in respect of the works for formation of road from viz., (i) Plot No.1220 to east side, (ii) Plot No.1191 to east side, (iii) Plot No. 1159 to east side, (iv) Plot No.1127 to east side (v) Plot No.1096 to east side (vi) Plot No.1064 to east side, (vii) Plot No.1229 to north side at Sivanna Nagar area (Nayee Brahmin Colony) in 5th Ward, Yemmiganur Municipality, is illegal and arbitrary. 2. Heard Sri Purna Chandra Sai.K, learned counsel for the Petitioner and Sri Gudapati Lakshmi Narayana, learned Standing Counsel appearing for the Respondent-Corporation. 3. The learned counsel for the Petitioner submits that Petitioner had completed the works within the time prescribed and the amounts are not being paid in spite of repeated requests. Hence, the present Writ Petition is filed. 3 4. The learned Standing Counsel for the Respondent- Corporation passed on the counter affidavit filed by the Commissioner, Yemmiganur Municipality Corporation, wherein it is stated that the works referred by the petitioner were executed pursuant to agreement No.74/23-24/E1, dated 20.11.2023. It is also stated at paragraph No.3 of the Counter affidavit that the admitted works under the agreement was completed and that the total value of the work done by the petitioner is Rs.10,53,812.56. After deduction, the net amount was Rs.9,08,099.00 and the said amount was uploaded in CFMS portal vide CFMS ID:2024-983597, dated 03.10.2024 and the said amount was paid. 5. In view of payment of amounts to the petitioner no further orders are required to be passed in the Writ Petition. Accordingly, the Writ Petition is closed leaving it open to the petitioner to work out his remedies in Civil Court for any amount due under the above mentioned executed works. There shall be no order as to costs.
