In this petition, petitioner has sought for the following relief:-
“It is prayed that this Hon’ble Court be pleased to call for records, hear the parties and quash the FIR in Cr. No.136 of 2025 Bagalur Police Station pending before Hon’ble Court of Civil Judge and JMFC, Devanahalli, for the offences punishable under Section 318(2) and 318(4) of the BNSS 2023 against as against the petitioner, to meet the ends of justice.”

Learned counsel for the petitioner – accused and
learned counsel for respondent – complainant have filed a Joint Memo along with Joint Affidavit duly signed by the petitioner, 2nd respondent and their respective counsel and the same are taken on record. 3. Petitioner – accused and his counsel and 2nd respondent and his counsel are physically present before the Court and they admit the contents of the Joint Affidavit, which reads as under:-
“JOINT AFFIDAVIT

We (1) JITENDER SINGH, son of Trilichan Singh Late, aged about 40 years, residing at No.G-202, Raaga Apartment, Kannur, Bengaluru – 562149 & (2) RANJITH DAN, son of Jaludan, aged about 29 years, Flat No-315, D X Max Solitaire Apartment, Banjara, Horamavu Agara post, Bengaluru – 43, do hereby solemnly affirm and state on oath as follows:
1. We i.e. Jithendra Singh is the Petitioner and Ranjith Dan the Respondent No.2 in the above Petition conversant with the facts of the case and competent to swear to this affidavit. 2. That, the Respondent No.2 have filed complaint against the Petitioner in Crime No.136/2025 pending before the Hon’ble Civil Judge and JMFC, Devanahalli for the offences punishable under Sections 318(2) and 318(4) of the BNS,
2023. 3. That, the Petitioner in order have amicable settlement has approached the Respondent No.2 to settle the dispute and agreed to repay the aforesaid due to the Respondent No.2 i.e., a sum of Rs.2,50,000/- paid and the Respondent do hereby admits, accepts and acknowledges the receipt of the aforesaid sum. 4. Further that, for the remaining sum of Rs.5,00,000/- the petitioner handed over and delivered the possession of his shop viz., Fabio Life style to the Respondent No.2 and

undertake that in future the petitioner have no claim, rights whatsoever over the said shop and undertake to execute necessary documents in favour of the Respondent No.2 as and when the Respondent No.2 called for. 5. That, in view of the aforesaid settlement, we the Petitioner and Respondent No.2 have settled our dispute with regard to aforesaid sum of Rs.7,50,000/- in Crime No.136/2025. Further that, the Respondent No.2 has no objection for quashing of FIR in Crime No.136/2025 against the petitioner herein in terms of joint memo.
Wherefore, we respectfully and humbly prays that this Hon’ble Court may be pleased to take on record this Joint affidavit Memo and dispose of the above petition in accordance with law, in the ends of justice and equity.”
4. In view of the aforesaid settlement entered into between the petitioner and 2nd respondent, I pass the following:
ORDER
(i) The petition is disposed of in terms of Joint Affidavit dated 26.06.2025.
(ii) The FIR in Crime No.136/2025 dated 11.06.2025 of Bagalur Police Station registered for the offences punishable under

Sections 318(2) and 318(4) of BNSS, 2023 pending on the file of the Civil Judge & JMFC, Devanahalli, in relation to the petitioner is hereby quashed.
