JUSTICE SAMEER JAIN Judgment 18/09/2025 Learned counsel for the petitioner has submitted that in spite of the petitioners’ repetitive representations and notices being given for withdrawal of the services (referred to at page-93 and 97) no cognizance is taken by the respondents qua the grievance [2025:RJ-JP:38185] (2 of 2) [CW-13856/2025] of the petitioner. Howsoever, learned counsel is unable to refute that in terms of Clause 27 and 28 of the contract in question and other relevant clauses of the contract, they have an efficacious alternate remedy, including an arbitration clause. In light of the said terms and conditions, the present petition is not tenable for want of alternate efficacious remedy being available. Accordingly, the present petition dismissed for availability of alternate remedy. Liberty is granted to the petitioner to avail the alternative efficacious remedy and if not satisfied with the consideration of grievances thereby, appeal qua the same may be preferred. Pending applications, if any, shall stand disposed. (SAMEER JAIN),J DEEPAK/12
