3 COMMON ORDER: Criminal Petition No. 8604 of 2025 has been filed by the petitioners- accused Nos. 1 and 2 and Criminal Petition No. 8605 of 2025 has been filed by the petitioner-accused No. 4, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to enlarge them on bail in crime No. 147 of 2025 of Kadapa Taluk U/G Police Station, Kadapa District, registered for the offence punishable under Section 103 (1) read with Section 3 (5) of the Bharatiya Nyaya Sanhita, 2023. 2. Since these two criminal petitions arise out of the same crime, they are heard together and are disposed of by way of this common order. 3. Case of the prosecution is that the deceased was having rivalry with accused No. 1 and others who belong to Marati Street on the pretext that the deceased previously murdered one Chimpiri Venkatesh who is brother-in-law of accused No. 1, for which the deceased was facing life threat from the hands of accused No. 1 and others. While so, on 15-04-2025 at about 8.40 p.m. when the de facto complainant-wife of the deceased was present in her house, one Anwar, belongs to their street, came to her house and informed that her husband was stabbed near built up circle and he was lying in pool of blood with injuries.
On coming to know the same, the de facto complainant along with her relatives rushed to the spot and found her husband in pool of blood. Immediately, they shifted the injured to RIMS Hospital, Kadapa, for treatment, where the duty doctors examined and injured and declared him as brought dead. 4
4. Sri G.Vijaya Kumar, learned counsel for the petitioners-accused Nos. 1, 2 and 4, contends that the petitioners are innocents of the alleged offence and have been falsely implicated by the police. It is further submitted that the petitioners are the sole earning members of their families and, therefore, their continued incarceration would cause undue hardship to their dependents. The petitioners undertake to strictly adhere to any conditions that may be imposed by this Court. In light of the foregoing, learned counsel prays that the present petition be allowed in the interest of justice. 4. Per contra, Ms. Akhila Naidu, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioners, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioners are released on bail at this stage, there is a strong likelihood that they may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing, it is urged that the petition be dismissed. 5. Heard learned counsel for the petitioners and learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the petitioners-accused Nos. 1, 2 and 4 had allegedly indulged in killing of the deceased by name Shaik Sadaq Valli. There are altogether 15 wounds found on the body of the deceased. L.W.5 is an eyewitness. L.Ws.6 to 13 are independent eyewitnesses. There is C.C. T.V. footage which had captured the alleged offence committed by all the
5 petitioners. The petitioners were arrested on 26-04-2025 and they have been in judicial custody for the past 127 days. After thorough investigation, the police filed charge sheet. Accusation is well founded against the petitioners. There is direct evidence available against the petitioners.
All the petitioners allegedly, by entertaining a common intention, brutally stabbed the deceased. There are no merits in the petitions and the same are liable to be dismissed. 7.
