JUSTICE SATYAVRAT VERMA ORAL ORDER 3 15-05-2025 1. Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 307, 504, 506 and 379 of the Indian Penal Code. 3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 05.11.2023 at about 09:00 p.m. the informant was in his field when all the FIR named accused persons including the petitioner along with 5-6 unknown accused came variously armed and petitioner assaulted the informant by farsa causing injury on his head, thereafter Anil assaulted the informant’s brother Bhaskar with gupti causing injury on his hand. Further, Mukesh assaulted the informant’s brother Mantun with farsa on his head, thereafter Hare Krishna snatched golden Patna High Court CR. MISC. No.22209 of 2025(3) dt.15-05-2025 2/3 chain of Bhaskar while Sunil took Rs.2,000/- from the pocket of Bhaskar and Sibesh took golden chakti of the informant and thereafter petitioner again assaulted the informant with butt of pistol. 4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that on account of dispute relating to land, an altercation had taken place in which both sides assaulted each other and even the injury suffered by the informant is simple in nature alleged to have been caused by a hard blunt substance. It is next submitted that petitioner is not a criminal. 5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner. 6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Biraul P.S.
