The criminal revision has been preferred challenging the order dated 17.4.2025 passed by the learned Judicial Magistrate, 4th Court (Charges Court ), Barrackpore, North 24- Parganas in M/Ex. Case No. 49 of 2022 thereby directing the petitioner herein to make payment of Rs. 84,000/- of arrear interim maintenance and issuance arrest of warrant.. 2. It is the case of the petitioner that warrant of arrest issued against him be set aside considering that he has been paying maintenance amount on regular basis. 3. It appears that vide the order under challenge , the Trial Court has issued 1 2 warrant of arrest against the petitioner. 4. On hearing the petitioner, the revisional application is disposed of with the direction that the warrant of arrest be stayed for a period of ten days. 5. The petitioner shall surrender before the trial Court and pray for regular bail within ten days from the date of this order failing which the order of stay shall stand vacated and the trial Court shall be at liberty to proceed in accordance with law. 6. It appears that the Misc. case has not been disposed of till date by the trial Court. 7. Considering the said fact the trial Court is directed to make all endeavour to dispose of the Misc. Case finally within three months from the date of this order without granting any unnecessary adjournment. 8. On payment of Rs. 30,000/- out of the arrear amount due by the petitioner 2 3 before the trial Court, the arrear maintenance as assessed shall remain suspended till disposal of the Misc. Case and also be subject to the final decision in the Misc. Case. 9. The criminal revisional stands disposed of. 10. All parties to act on the server copy of this order. ( Shampa Dutt (Paul), J. ) 3
