ORDER:
The instant Criminal Petition is filed by the Petitioners under Section 528 of B.N.S.S., 2023 for the following relief:
“ ... to quash the proceedings against petitioners herein i.e., Respondents in DVC.No.4 of 2024 on the file of Hon’ble Judicial First Class Magistrate At Nuzvid and pass ...”
The marriage of Respondent No.2 herein was performed with Petitioner No.1 herein on 12.05.2022 in the presence of elders. The parents of Respondent No.2 gave dowry and other lanchanams to the petitioners herein.
Due to disputes between the couple, wife and husband lived separately and respondent No.2 filed DVC No.4 of 2024 on the file of the Court of Judicial First Class Magistrate, Nuzvid against respondents 1 to 7 (Petitioners 1 to 7 herein), who are husband, mother in law, sisters-in-law and their husbands. Seeking quashment of the Proceedings against them in DVC, Petitioners herein filed the present criminal petition. 3
During the pendency of this Criminal Petition, on 22.08.2025, parties made a request before this Court that they intend to compromise the matter and accordingly, directed the parties to appear before the Secretary, High Court Legal Services Committee, High Court of Andhra Pradesh, Amaravati on 29.09.2025 for taking necessary steps. Mediation proceedings are conducted and the parties and the Advocate as a Mediator appeared before the Mediation Centre and a Mediation Report is filed by the learned Advocate & Mediator appeared on behalf of the Petitioners/Accused. Mediation Report reveals that both parties agreed to withdraw all the cases pending between them and respondent No.2 herein agreed that Petitioner No.1 paid an amount of Rs.8,00,000/- to her and she received and acknowledged the same as full and final settlement and they will apply for divorce by mutual consent. Parties are identified by their respective learned counsels on record. Copies of the Aadhar cards of the parties attested by their respective counsel are filed for proper identification. Learned Assistant Public Prosecutor is in attendance. Respondent No.2 submitted before this Court that she has no issues with the Petitioners and there is no coercion and undue influence for settling the issue with the Petitioners and she acknowledged receipt of Rs.8,00,000/- paid by petitioner No.1 herein. 4
Considering the submissions, in the interests of justice, this Criminal Petition is allowed and the Proceedings in DVC No.4 of 2024 on the file of the Court of Judicial First Class Magistrate, Nuzvid, against the Petitioners 1 to 7 / Respondents 1 to 7 are hereby quashed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
