This appeal challenges the judgment of conviction dated 18.10.2023 and order of sentence dated 9.2.2024 passed by Additional Court No.2, Ghaziabad in Complaint Case No. 1316 of 2022, thereby convicting the appellant under Section 138 Negotiable Instruments Act, 1881, followed by imposition of sentence of six months with fine of Rs.6,00,000/-, with a further condition that in the event of non deposit of fine, convict shall undergo further imprisonment of two months. Learned counsel for appellant states that the appeal against the impugned judgment of conviction and order of sentence dated 9.2.2025 passed by trial court in a complaint case, under Section 138 Negotiable Instruments Act, 1881 would lie before the Court of Sessions and the appeal has been filed inadvertently before this Court. He prays for withdrawal of this appeal to avail the remedy of appeal before the court of competent jurisdiction. The appeal is dismissed as withdrawn.
