The petitioner, who was working in the respondent- University is before this Court under Article 226 of the Constitution of India with the following prayer:
“A writ in the nature of mandamus or any other appropriate writ or order directing the respondent Nos.1 to 5 to disburse/pay salary and personal benefits of Rs.3,23,085/- with interest @ 18% per annum from the date 01.06.2017 till realization.”

2. Heard the learned counsel Sri.Somashekar Kashimath for petitioner, learned counsel Sri.Cyril Prasad Pais for respondent Nos.1, 3 and 4 and learned Additional Government Advocate Smt.Prathibha.R.K., for respondent No.5. Perused the writ petition papers.
3. The petitioner has sought for a writ of mandamus directing respondent Nos.1 to 5 to disburse/pay salary and personal benefits of Rs.3,23,085/- with interest at 18% p.a.

Learned counsel Sri.Cyril Prasad Pais for respondent Nos.1, 3 and 4 points out from the statement of objections filed that, under the document No.9, Communication dated 27.06.2023, petitioner’s request for payment of arrears of salary is rejected for the reasons stated therein. Since the petitioner’s request is already rejected and as the petitioner has not challenged the said Communication, he submits that the writ petition would not be maintainable.

A mandamus could be issued when the petitioner establishes his legal right and correspondingly establishes failure on the part of the respondents to consider the request for performing their legal duty. In the instant case, the respondents have considered the request of the petitioner and under Communication dated 27.06.2023 rejected the request of the petitioner. When the request of the petitioner is already rejected, no mandamus could be issued to the respondents. It is open for the petitioner to challenge the Communication where the request of the petitioner is rejected.
6. With the above, writ petition stands
disposed of.
