The present Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant – complainant to direct the court of Additional Chief Judicial Magistrate/ Additional Civil Judge (Senior Division), Roorkee, District Haridwar to decide the Complaint Case No.882 of 2021,
“Apekshit Tyagi vs. Monu alias Vivek Tyagi”, filed under Section 138 of the Negotiable Instruments Act, 1881, within the stipulated period.

Heard Mr. Prince Chauhan, learned counsel for the applicant.

In Indian Bank Association and Others vs. Union of India and Others, (2014) 5 SCC 590, the Hon’ble Supreme Court has directed all the Criminal
2025:UHC:1508 2 Courts in the country dealing with the cases under Section 138 of the Negotiable Instruments Act, 1881 for speedy and expeditiously disposal of the cases falling under Section 138 of the Negotiable Instruments Act, 1881.

Having heard and keeping in mind the directions of the Hon’ble Supreme Court, the concerned Magistrate is directed to expedite the proceedings of the said Complaint Case (Complaint Case No.882 of 2021), filed under Section 138 of the Negotiable Instruments Act, 1881 and complete the trial most expeditiously without granting any unnecessary adjournment to the either party.

The Criminal Miscellaneous Application No.191 of 2025, filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is disposed of accordingly. ___________________ ALOK KUMAR VERMA, J.
