Pranav Malhotra Vs. State of Himachal Pradesh & Ors. CWP No.4325 of 2024 28.10.2025 Present: Mr. Deven Khanna and Mr. Sambhav Bhasin, Advocates, for the petitioner. Mr. Anup Rattan, Advocate General, Mr. Rajan Kahol & Mr. Vishal Panwar, Additional Advocates General with Mr. Ravi Chauhan & Mr. Anish Banshtu, Deputy Advocates General, for the respondents-State. CMP No.24232 of 2025
By way of instant application filed under Section 151 CPC, prayer has been made on behalf of the applicant/petitioner for release of MBBS Degree. Pursuant to notices issued in the instant application, respondents have filed reply, wherein prayer made in the instant application has been opposed on the ground that though bond money amounting to Rs.40,00,000/- has been deposited by the applicant/petitioner, but till date he has not been deposited interest amounting to Rs.7,890/-, as such, documents cannot be released to him. It also came to be argued on behalf of the non-applicant/respondents that besides interest upon bond money, petitioner is also under obligation to pay the stipend amounting to Rs.15,80,320/- received by him during PG course. Since it is not in dispute that applicant/petitioner has already deposited sum of Rs.40,00,000/-, coupled with the fact that vide order dated 20.05.2024, this Court has already directed that respondents shall not take any coercive action
against the petitioner for recovery of Rs.15,80,320/- i.e. the amount of stipend drawn by him during PG course period, this court sees no impediment in issuing direction to the non- applicant/respondents to release the MBBS Degree to the petitioner subject to his depositing interest amounting to Rs. 7,890/- with the Registry of this Court within one week from today. Since petitioner has got fellowship in Critical Care, Bangalore and for that purpose, he requires MBBS Degree, coupled with the fact that bond amount already stands paid to the non-applicant/respondents, this Court deems it fit to dispose of the present application with a direction to the respondents to hand over the MBBS Degree to the petitioner through his counsel within two days, however, same shall be subject to the outcome of the writ petition. Ordered accordingly. Application stands disposed of. Mr.
Ordered accordingly. Application stands disposed of. Mr. Rajan Kahol, learned Additional Advocate General, has noted down the gist of order passed by this Court and has assured that needful, in terms of instant order, shall be positively done within four days, failing which official responsible for delay shall render himself liable for penal consequences as well as Contempt of Court.
