JUSTICE S.R.KRISHNA KUMAR ORAL ORDER After arguing the matter for sometime, the learned counsel for the petitioner submits that the present petition may be disposed of by setting aside the proclamation and attachment issued as against the petitioner / accused No.2 and reserving liberty in favour of petitioner to approach the Trial Court and contest the proceedings, in accordance with law. 2. Submission is placed on record. 3. The Petition stands disposed of directing the petitioner to approach the Trial Court on the next date of hearing of C.C.No.8101/2024, which is presently posted before the Trial Court on 19.08.2025. It is further directed that the order passed by the Trial Court directing issuance of proclamation and attachment warrant as against the petitioner are hereby set aside, subject to the condition that the - 4 - HC-KAR NC: 2025:KHC:24537 CRL.P No. 8918 of 2025 petitioner shall appear before the Trial Court on 19.08.2025, without fail. It is made clear that in the event the petitioner does not appear before the Trial Court on 19.08.2025, the proclamation and attachment warrant shall stand revive and respondent as well as the Trial Court shall be entitled to proceed further, in accordance with law.
