THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 4874 OF 2015
ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the action of the respondents in insisting upon obtaining trade license for the stores/outlets (list of such stores/outlets along with addresses is filed as annexure P-1) of the petitioner company within the limits of respondent jurisdiction though the same was not included in Schedule P of Section 521 of the Greater Hyderabad Municipal Corporation Act, 1955 and thereby is not required to obtain the license in respect of stores/outlets as arbitrary, illegal and without jurisdiction and ultra virus of the powers of the respondents and pass such other orders....”
2. Heard learned counsel for the petitioner and learned Standing Counsel for the Respondents.
3. During hearing learned counsel for the petitioner would contend that this matter is squarely covered by an order of this Court, dated 14.07.2014 in W.P.No.7299 of 2009 and requested to pass similar order in this writ petition also. Learned Standing Counsel for the respondents conceded the same.
4. Considering the submissions of learned counsel, this Writ Petition is
disposed of in terms of the order passed in W.P.No.7299 of 2009, dated 14.07.2014 and the impugned order is hereby set aside. There shall be no
order as to costs. As a sequel, miscellaneous applications pending, if any, shall also stand closed.
