Order No.
ORDER(ORAL) 03.02.2026
02.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is an application U/S.483 of BNSS by the petitioner for grant of bail in connection with Mohana P.S. Case No. 118 of 2025 corresponding to G.R. Case No. 167 of 2025 pending in the file of learned JMFC, Mohana, for commission of offences punishable U/Ss. 103(2)/127(2)/ 238(a)/3(5) of BNS r/w. Sec.4(1) of the Odisha Prevention of Witch Hunting Act, on the main allegation of committing murder of Karuna Dalai on the suspicion of practising black magic (Witchcraft), along with co-accused persons in furtherance of their common intention.
3. Heard, Mr. Jyotirmaya Sahoo, learned counsel for the petitioner and Mr. T.K. Acharya, learned Addl. PP in the matter and perused the record.
4. After having considered the rival submissions upon perusal of record, there appears allegation against the petitioner for committing murder of the deceased, but the main item of evidence against the petitioner allegedly emanates from the statement of witnesses-Neta Mallick p. 2 and Mami Mallick, who having been examined as PWs.1 & 2, have not supported the prosecution allegation against the petitioner. Besides, the petitioner is in custody since 04.09.2025 along with her infant child aged about 3 years 4 months, which is evident from the certified copy of the
order sheet of the learned JMFC, Mohana as produced. In view of the above facts and circumstances and taking into account the materials placed on record and keeping in view the evidence of material witnesses not supporting the allegation against the petitioner, this Court without expressing any view on merits admits the Petitioner to bail.
5. Hence, the bail application of the Petitioner stands allowed and the Petitioner is allowed to go on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty- five Thousand) only with one solvent surety for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it.
6. Accordingly, the BLAPL stands disposed of. Issue urgent certified copy of the order as per Rules.
