A case has been registered against the Petitioner for the OffenCeS punishable under sections 236, 316(2), 318(2) and 318(4) of the Bharat'lya Nyaya Sanhitha (for short lBNS). 3. Case of the prosecLJtjOn, in brief, Its that the petl-tioner gave a false Jr, statement I-n the declaration claimI'ng to be a rest-dent of MachinenipaIIe village and became a Member of the MachinenI'PaIIe Milk Society and further the petIItl'oner was elected as president of the Machinenl-palle Milk Society and also became the chairman of vI'jaya Milk Dairy and created a loss to the Milk Society by mjsappropriatI-ng the funds in the society. 4, Heard. Perused the record. 5. Learned counsel appearing on behalf of the petitl-oner further submitted that the petitioner herel'n is a resident of Machinenipalle vl'lJage, and in view of change in the regime, the present complaI'nt has been filed against the petI'tiOner herein with a ma/a r,-de intention. 6. A perusal of the record goes to show that a certificate is alleged to be produced by the petitioner herein that he is a resident of Machinenipalle of Rudravaram Mandal, NandyaI District. AccordI-ng tO the prosecution, the sal'd Residence Certificate is a false certificate. 7. Learned counsel for the petitioner further submitted that elections for the Society are ll'kely to be held in a couple of months. petitioner is the Managing Director of the said society.
