The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
“…to issue any writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 3rd respondent in not allowing the petitioner to represent the Document No.P152/2021 though the land is deleted from the prohibited list under G.O.Ms.No.89 Revenue(Lands.V) Department dated 02.03.2023 and declare the orders passed the 3rd and 2nd respondents dated 16.10.2021 and 29.03.2022 respectively, are illegal, arbitrary and violation of principles of natural justice and to consequently set aside the same and further direct the respondent No.3 to receive register and release Document No.P152/2021 and to pass such other order or orders as this Hon’ble Court may deems fit just and proper in the circumstances of the case.”

Shorn of all unnecessary facts asserted in the affidavit filed in support of the writ petition, the specific case of the petitioner is that the respondent authority is not registering the document though the Government has deleted the property from the prohibitory property list under Section 22-A of the Registration Act. 3. The learned State Counsel has placed the written instructions addressed by the 3rd respondent/Sub-Registrar, Prathipadu to the Government Pleader for Revenue, wherein it is stated that vide G.O.Ms.No.89 Revenue (Lands.V) Department, dated 02.03.2023, the survey number of the petitioner’s property was deleted from the
4 prohibited property register and there is no prohibition for registration of the property of the petitioner. It is further stated that the petitioner has not represented the document No.P152/2021 before the 3rd respondent and the petitioner is put to strict proof of the same and it is absolutely false to aver that the 3rd respondent is not allowing the petitioner to represent the document and the petitioner filed the present writ petition without any bonafide grounds. 4.
In view of the averments made in the written instructions, this Court deems it appropriate to dispose of this writ petition directing the petitioner to represent the Document No.P152/2021 before the concerned Sub-Registrar within a period of one week and on receiving the same, the Sub-Registrar concerned is directed to process the document for registration as expeditiously as possible, in accordance with law,. 5. With the above said direction, the Writ Petition is disposed of. There shall be no order as to costs.
