Mohendro, learned counsel for respondent and Mr. R.K Umakanta, learned GA for the State respondent are present before the Court physically. Proceeding in MC(Rev. Pet.) No.14 of 2019 is arising out of the WP(C) No.629 of 2017 and this proceeding has been initiated by filing an application Under Section 5 of the Limitation Act, 1963 for seeking condonation delay of 57 days in review petition as stated therein. Singjamei Police Station, Imphal West district, Manipur has recorded a case in FIR No.72(2)2017 SJM P.S. Under Section 147/148/506/427 read with section 34 of IPC, 1860 and Section 27 of Arm Act. 2 Whereas in this proceeding seeking for condonation delay of 57 days but in so far as the FIR which has recorded by the aforesaid investigating agency and therein the investigating agency had completed the investigation. Keeping in view the relevant provision of Code of Criminal Procedure and filing the charge-sheet as under section 173 of the Code of Criminal procedure(CrPC) however, it is clarified that charge-sheet/final report/challenge has also been filed. Therefore, there is no consequences for seeking condonation of delay in this proceeding as sought for. When once the Charge-sheet has been filed finally Under Section 173 of the Code of Criminal Procedure (CrPC), no consequences for consideration of this application. Therefore, the aforesaid proceeding is dismissed as it becomes infructuous. CHIEF JUSTICE Ab. Surjit
