Ramana, learned counsel for the petitioner and Sri Sarath, learned Assistant Government Pleader for Services - II appeared for respondents. SRS,J W.P.No.576 of 2025 2. A charge memo vide No.DS (2) 3334/2013, dated 31.10.2013 (Ex.P6) was issued against the petitioner. The petitioner submitted a written defence dated 03.11.2013 (Ex.P7). The inquiry officers submitted a report to the disciplinary authority vide Letter No:JDMA/JA/A/148/2013, dated 12.01.2018 (EX.P12). The petitioner submitted objections dated 21.05.2019 (Ex.P13). The disciplinary authority remitted the matter to the inquiry officer vide Memo No.4781/Vig.ll(1)/2013, dated 11.06.2021 (Ex.P14). Thereafter, a memo vide No.JDM/VJA/A/148/2013, dated 01.12.2023 (Ex.P15) was issued, directing the petitioner to attend the inquiry scheduled on 08.12.2023. 3. On a similar set of facts, a case in Cr.No.40 of 2013 for the offences punishable under Section 409, 420, 467, 468, 471, 379 r/w 34 of IPC was registered against the petitioner and two others. A charge sheet was filed on the file of the learned Addl. Junior Civil Judge, Repalle and the same was numbered as C.C.No.218 of 2018. Learned counsel for the petitioner would submit that despite the G.O.Ms.No.679 General Administration (Services-C) Department, dated 01.11.2008 and G.O.Ms.No.91 General Administration (Ser.C) Department, dated 12.09.2022, fixing timelines to complete the inquiry within six months in complicated and three months in simple cases respectively, the inquiry has not been concluded by the respondent authorities. Learned counsel also would submit that though the petitioner is eligible for promotion, the respondent authorities are not considering the case of the petitioner for promotion, due to the pendency of the aforementioned charge memo and a criminal case. 4. 5. The criminal case is pending on the file of the learned Addl. Junior Civil Judge, Repalle. However, the docket proceedings of said criminal case, was not filed before this Court. 10. 11. The respondent authorities failed to adhere to the time limits fixed in G.O.Ms.No.679 General Administration (Services-C) Department, dated 01.11.2008 and G.O.Ms.No.91 General Administration (Ser.C) Department, dated 12.09.2022. For the lapses of the disciplinary authority in completing the inquiry, the petitioner shall not be penalized. However, one should not forget the fact that criminal case against the petitioner is still pending. The Government issued G.O.Ms.No.257 General Administration (Ser.C) Department dated 10.06.1999 to meet such a contingency. Given the facts and circumstances of the case, the Writ Petition is disposed of, at the stage of admission with the consent of both the learned counsel, directing the learned respondent No.1 to consider the case of the petitioner for promotion in terms of G.O.Ms.No.257 General Administration (Ser.C) Department, dated 10.06.1999, if the petitioner’s case is in the zone of consideration, without reference to the aforementioned charge memo as and when the DPC is conducted.
