Dhaulta, Additional Advocate General. ------------------------------------------------------------------------------------ Jyotsna Rewal Dua, Judge Following order was passed in this matter on 18.09.2025:- “Learned Deputy Advocate General has placed on record pay fixation order of the petitioner issued on 16.06.2023. He has also placed on record office instructions dated 07.08.2025, in terms of which, arrears admissible to the petitioner w.e.f. April, 2017 were calculated in the sum of Rs.14,14,460/- and first installment of arrears, i.e. Rs.2,86,622/-, was released to him in light of government instructions dated 07.01.2012. Learned counsel for the petitioner submits that no further installments have been released in favour of the petitioner. Further, the arrears due to the petitioner in terms of the decision rendered in his favour even otherwise cannot be restricted by the respondents to be paid in installments. Learned Deputy Advocate General prays for and is allowed two weeks’ further time to have instructions 1 Whether reporters of print and electronic media may be allowed to see the order? Yes 2 about releasing the entire arrears due in favour of the petitioner. List after two weeks.” 2. The above order was not complied with, which led to passing of following order on 13.10.2025:- “Despite grant of opportunities, no further instructions have come forth from the respondents. At the request of learned Additional Advocate General, the matter is adjourned by two weeks in terms of previous order, subject to the cost of Rs.5500/- to be paid to the petitioner on the next date. List on 31.10.2025.” 3. Today, when the matter was taken up, learned Additional Advocate General has placed on record office instructions dated 30.10.2025, conveying payment of costs as imposed in favour of the petitioner. Learned Additional Advocate General has also placed on record separate office instructions dated 30.10.2025 from the Directorate of Youth Services & Sports, Himachal Pradesh, which, inter alia, convey as under:- “It is further submitted that as per the request made by this office, the Government of Himachal Pradesh has provided an additional budget to the tune of Rs.24,32,449/- in the relevant budget head on dated 30-10-2025 under SOE 01-Salary (Charged). This additional budget has further allocated to the office of the Resident Commissioner, Pangi on dated 30-11-2025 (Annexure “B"). The Resident Commissioner, Pangi has been requested vide this office letter No.Exe.Pet.108/ 2025/YSS/-4237, dated 30-10-2025 to release the entire balance amount of arrear to the petitioner Sh. Prem Singh. The entire balance amount along with amount of cost, will be deposited in the bank account of 3 the petitioner Sh. Prem Singh soon by the office of the Resident Commissioner, Pangi.” 4. Learned Additional Advocate General, on the basis of instructions imparted to him by Sh. Kamal Jeet Singh, Superintendent (Retired) (Re-employed), Directorate of Youth Services & Sports, Himachal Pradesh, submits that needful in terms of the aforesaid office instructions shall be carried out within next four working days. Taking note of the office instructions as also the submissions made by learned Additional Advocate General, the present execution petition to stand disposed of. Liberty is, however, reserved to the petitioner to seek appropriate remedy for the redressal of his surviving grievances, if any, in accordance with law.
