This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of CrMP No. 3215 of 2024 to its original file. Learned counsel for the petitioner submits that the CrMP No. 3215 of 2024 was dismissed for non-prosecution vide order dated 29.11.2024. Learned counsel for the petitioners submits that due to ill health of the conducting counsel, he could not be present when the case was called out, which resulted in dismissal of Cr.MP no. 3215 of 2024. It is further submitted that the petitioner has very good grounds to agitate in this case and unless the same is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that Cr.MP no. 3215 of 2024 be restored to its original file. Learned Addl. P.P. has no serious objection for the prayer of restoration. Considering the aforesaid submission of the learned counsel for the petitioner, Cr.MP no. 3215 of 2024 is restored to its original file to the stage, at which, it was before its dismissal.
