Mr. Imran Khan, Advocate, for the respondent. CMP-T No.598 of 2025 Heard. 2. In view of the averments made in the application, application for early hearing is allowed. Application stands disposed of. CWPOA No.6287 of 2020 3. Pursuant to orders dated 25.11.2024, the Respondent-Federation had filed the Supplementary Affidavit dated 17.04.2025. 4. Perusal of Para 7 of the Supplementary Affidavit states that as per the communication dated 04.06.1992 [Annexure A-3], a proposal was floated for equating the Foremen in the Respondent-Federation in Himachal Road Transport Corporation and Himachal Pradesh State Electricity Board. It is further averred that the aforesaid proposal was never approved and no foremen in the Respondent-Federation was granted pay at par with employees of Himachal Road Transport Corporation and Himachal Pradesh State Electricity Board. 5. Para 7 of the Reply-Affidavit further indicates that the matter is otherwise, for the reason, that at the request of petitioner and other employees, a joint representation was submitted on 09.05.2018 whereby, the petitioner-other incumbents who were Foremen in Federation, had agreed to the proposal to enhance their Grade Pay equivalent to post of Technical Superintendent in Federation and on their request, the same was accepted and they were equated with Technical Superintendent after due approval by the Board on 27.09.2017 giving them Grade pay of Rs.4400/- from earlier Grade Pay of Rs.3800/- w.e.f. 01.11.2015 and therefore, the petitioner cannot turn around and claimed a different status. 6. At this stage, Learned Counsel for the petitioner prays for two weeks’ time to file response to Supplementary Affidavit, to the following effects:- (i) Whether the proposal dated 04.06.1992 [Annexure A-3] was every accepted by the Federation? (ii) Whether any employee upon acceptance of the proposal has been granted the pay scale and grade pay at par with Foremen in Himachal Pradesh Road Transport Corporation and Himachal Pradesh State Electricity Board? 7. Let needful be done within two weeks and the matter be listed on 11th December, 2025.
