Heard the parties.
Petitioner has been made accused in connection with Nawdiha Bazar P.S. Case No. 18 of 2022, corresponding to G.R. Case No.895 of 2022, S.T. No.382 of 2024, for the offences registered under Sections 147/148/149/307/353 of the Indian Penal Code, section 25(1-A)/25(1-B)(a)/26/35/27 of the Arms Act and Section 17 of the CLA Act., pending in the Court of learned Additional Sessions Judge-VIII, Palamau at Daltonganj.
Bail Application of the petitioner was earlier rejected by a Co-ordinate Bench of this Court vide B.A. No.4116 of 2023 by order dated 22.12.2023.
On 27.02.2022, Nawadiha police on the basis of confidential information that some ultras had assembled in village Turkun, Nawadiha bazar, raided the place of occurrence. There ensued an encounter between the extremist and police party in which one accused Ranjan Ji sustained firearm injuries. However, none of the members of police party had sustained any injury.
It was submitted that co-accused Sunil Paswan against whom there is similar allegation, has been granted bail by this Court vide B.A. No.7788 of 2024. It was further submitted that petitioner is in custody since 30.08.2022.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-VIII, Palamau at Daltonganj, in connection with Nawdiha Bazar P.S. Case No. 18 of 2022, corresponding to G.R. Case No.895 of 2022, S.T. No.382 of 2024.
