LAKSHMANA RAO CRIMINAL PETITION NO: 8569/2025 Between: Ravuri Rambabu and others ...PETITIONER/ACCUSED{S) AND The State Of Andhra Pradesh ...RESPONDENT/COMPLAINANT Counsel for the Petitioner/accused(S): Papudippu Sashidar Reddy Counsel for the Respondent/complainant; Public Prosecutor The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the Petitioners/Accused for granting of pre-arrest bail in connection with Crime No.24 of 2023 of Thulluru Police Station, Guntur District, registered for the alleged offences punishable under Sections 324 read with 34 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C.). 2 Dr.YLR, J Crl.P.No.8569of2025 Dated 28.08.2025 2. The case of the prosecution is that the Complainant purchased a lorry from Ponnam Suresh in August 2021 for Rs.1,60,000/- under agreement stating no dues were pending. Later, while returning from Gauhati, some persons stopped the lorry near Badraka Toll Plaza, claiming dues of Rs.1.96 lakhs towards diesel. To release the vehicle, Rama Krishna paid the amount via PhonePe. When demanded, Suresh initially sought time but later refused to repay and threatened him. On 03.02.2023 at about 8:30 PM, while Rama Krishna stopped near S.R.T Electrical Shop, Mandadam, Suresh and his followers attacked him. Suresh hit him with a stone on the head; others assaulted him further, causing bleeding injuries to his forehead, left knee, and backbone. They also snatched his gold chain and cash. Locals informed his brothers Balakrishna & Veeranjaneyulu, who shifted him to Capital Hospital, where his statement was recorded. Hence, based on the hospital statement, the FIR was registered for offences of assault, hurt, and theft. an 3. Sri P. Sashidhar Reddy, the learned counsel for the petitioners contendjthat the petitioners are innocent of the alleged offence and have been falsely implicated by the police. It is further submitted that the petitioners are the sole earning members of their family and, they are I 3 Dr.YLR, J Crl.P.No.8569 of 2025 Dated 28.08.2025 I ready to abide any conditions that may be imposed by this Court, and it is urged to grant pre-arrest bail to the petitioners. 4. Per contra, Ms.P.Akhila Naidu, the learned Assistant Public Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioners, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioners are released on pre-arrest bail, there is a strong likelihood that they may abscond, thereby hampering the ongoing investigation i and evading the process of law. In view of the foregoing submissions, it is urged that the petition be dismissed. '5. Heard the learned counsel for the petitioners and the learned Assistant Public Prosecutor. Perused the record. 6. As seen from the record, the Petitioners/Accused Nos.2, 3, and 5 I (Petitioner No.4 has not been arraigned as an accused so far) apprehend that they may be arrested in connection with the present case. The Petitioner/Accused No.4 was already arrested and released on bail on the same day by the learned Jurisdictional Magistrate. Accused No.1 has not yet been arrested. There is no reference about the Petitioners/Accused Nos.2, 3, and 5 in the statement of the de facto complainant. The petitioners contend that they are falsely implicated in 1 4 Dr.YLR, J Crl.P.No.8569 of 2025 Dated 28.08.2025 this case because of previous disputes in between the petitioners and the de-facto complainant. In his statement, the de facto complainant mentioned only the name of Accused No.1 and some others. It is alleged by the de facto complainant that Accused No.1 beat him with a stone, while the other accused assaulted him with hands and legs. 7. Considering, the gravity and nature of the allegations leveled, against the Petitioners/Accused, their alleged role played in this case, this Court deems it fit to grant pre-arrest bail to the petitioners. I I 8. In the result, the Criminal Petition is allowed with the following conditions: f i. In the event of his arrest, the Petitioners/Accused shall be enlarged on bail subject to they executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials; The^ Petitioners/Accused shall make themselves available for investigation as and when required; iii. The Petitioners/Accused shall appear before the Station House Officer concerned once in a week i.e. every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet.
