This anticipatory bail application under Section 482 of the Bharatiya Nyaya Suraksha Sanhita, 2023, has been preferred by the petitioner apprehending his arrest for offences under Sections 316(2), 318(4), 338, 336(3), 340(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned A.P.P. representing the State and learned counsel representing the informant oppose the prayer for anticipatory bail. 4. The allegation in the F.I.R. is that the father of the informant was maintaining a Bank account which was having sufficient balance amount to the tune of Rs.18,59,451.66/- . It is alleged that his father died on 17.08.2024. On 10.09.2024, when the balance was inspected, it was found that only Rs.65.66/- is left in the said account. It was found that huge transaction was made from the aforesaid account. 5. After hearing the parties, I find that from the account of father of the informant, on 30.07.2024 i.e. before the death of his father, an amount of Rs.1,50,000/- was transferred to the account of this petitioner. 6. It is an admitted case of the parties that the amount 2025:JHHC:16868 was transferred by the Account Paying Cheque. 7. The allegation is that the Bank officials and another Advocate and one Arjun Mistry, who happens to be the brother of the informant had hatched a conspiracy and got the amount transferred. 8. After hearing the parties, I find that since it is an admitted case that the amount was transferred through the Account Paying Cheque in the account of this petitioner and there is no allegation that the petitioner has hatched conspiracy, and further there is nothing to suggest that the signature in the Cheque is forged. 9. Considering the aforesaid fact, I am inclined to allow this application. 10. Accordingly, this Anticipatory Bail Application stands allowed. The petitioner, above named, is directed to surrender before the learned court below within four weeks from the date of receipt of copy of this order and on the event of his surrender or arrest, he shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand), with two sureties of the like amount each, to the satisfaction of learned JMFC, Dhanbad, in connection with Jorapokhar P.S.
