BEFORE HONOURABLE MR. JUSTICE RAJESH MAZUMDAR ORDER Date : 20.01.2026 Heard Mr. B.K. Mahajan, learned counsel for the petitioner and Mr. D.P. Goswami, learned Addl. Public Prosecutor for the State respondent. This is an application under Section 483 of the BNSS, 2023, petitioner namely, Santosh Chouhan has prayed for regular bail in connection with Bhuragaon P.S. Case No. 73/2025 under Section 77 of BNS, 2023 read with
Page No.# 2/3 Section 67(A) of the Information Technology Act, 2000. The case diary is received and perused. By order dated 19.12.2025, this Court has granted an interim bail to the petitioner subject to the following conditions:- (i) That the accused person shall co-operate with the investigation and appear before the I/O for further examination. (ii) That the accused person shall not hamper or tamper with the evidence. (iii) That the accused person shall not communicate with the informat or other witnesses. In case of any violation of the aforesaid conditions or if any involvement is found in any social media activities during this period, the bail shall be rejected, if the same is brought on the notice of the Court. An additional affidavit has been filed by the petitioner, stating that all the conditions given by this Court vide order dated 19.12.2025 have been complied with and the petitioner has ensured that the he shall continue to cooperate with the investigation as and when required. Perusal of the case diary does not require that the custodial interrogation of the petitioner is necessary at this stage. In view of the above, the protection made by order dated 19.12.2025 is hereby made absolute. It is further made clear that the petitioner shall continue to abide by all the conditions made vide order dated 19.12.2025 and any violation of the aforesaid conditions may entail cancellation of the privilege of bail granted to
