JUSTICE A. GUNESHWAR SHARMA Order 18.11.2025 [1] Heard Mr. N. Umakanta, learned senior counsel assisted by Ms. Sapna, learned counsel appearing on behalf of the petitioner, Mr. Th. Sukumar, learned G.A. for the State respondent and Mr. L. Raju, learned counsel for respondent No. 2 (IMC). [2] Mr. N. Umakanta, learned senior counsel for the petitioner, submits that the petitioner is an advertising company having office at Babupara, Imphal West. [3] In the course of business, the petitioner has erected one Unipole structure within the campus of Youth Rising Star Club in Kwakethel Heinoukhongnembi Leikai. However, when Unipole structure was erected on 22.06.2019, some persons identifying as officials of the Imphal Municipal Corporation came and directed the petitioner to remove the pole as it is against the Municipal law. [4] Vide order dated 26.06.2019, this Court passed an interim order that the pole erected by the petitioner in private area shall not be removed till the next date and the interim order has been extended from time to time. [5] Mr. Th. Sukumar, learned G.A., submits that in the writ petition, the petitioner failed to show the cause and identity and particulars of the persons who made threaten to the petitioner and others have not been identified and the writ petition is filed on mere presumption. [6] Mr. L. Raju, learned counsel for the IMC, submits that location at Kwakeithel is beyond the jurisdiction of the Imphal Municipal Corporation and also assures the Court that none of his members have issued direction to the petitioner to remove the Unipole structure. In the circumstances, the writ petition may be dismissed on this point alone. [7] This Court has perused the materials on record and it is evident that Unipole structure was erected in the private place belongs to the Youth Rising Star Club and from the map of Imphal Municipality, it is seen that the location where Unipole hoarding is beyond the jurisdiction of the Imphal Municipal Corporation and considering the submissions of Mr. L. Raju, learned counsel for the IMPC, that the area is beyond the jurisdiction and none of the member has issued any direction as alleged. [8] This Court is of the opinion that there is no impediment in maintaining the Unipole structure erected at the private places, if the same is as per permissible by the law.
