1. Learned Counsel appearing for the Petitioner submits that the objection raised by the Registry is not in accordance with law and Digitally signed by GOPAL SINGH Date: 2025.01.21 11:37:33 +0530
2 this case will lie as a service matter as the matter relates to grant of residential quarter also. He has placed reliance on a judgment of a Division Bench of Andhra Pradesh High Court in the case of S. Mallikarjuna Rao v. Government of A.P., 2006 SCC OnLine AP 436.

Considering the facts and circumstances of the instant case and considering the material available, I am of the view that the Registry has rightly raised the objection and has rightly directed to file an appropriate petition for hearing before an appropriate Bench. I am not convinced with the aforesaid judgment of the Division Bench. The said judgment is distinguishable on facts.
3. At this stage, Learned Counsel for the Petitioner seeks to withdraw the instant petition with liberty to file an appropriate petition for hearing before an appropriate Bench.
