1. Heard Mr. Aman Kumar Kesharwani, learned counsel for the petitioner as well as Ms. Upasana Mehta, learned Dy. Government Advocate for the State/respondent/s.

Learned counsel for the petitioner submits that without there being any acquisition proceeding their lands have been acquired and the land so acquired has been allotted to respondent No.5 and a cement factory has been constructed over the same. 3. On the other hand, learned counsel for the State submits that the submission advanced by the petitioner is without any basis. She fairly submits that however, if the petitioner will file appropriate application/representation along with relevant documents, it will be duly considered by the Incharge Officer, Land Acquisition, District Janjgir Champa. 4. Considering the facts and circumstances of this case, if any application/representation is filed along with copy of this order within a period of 15 days, the respondents No.2 & 3 are directed to decide the application/representation of the petitioner in accordance with law and if it is found that the land of the petitioner
3 has been acquired without any land acquisition proceeding than they may initiate land acquisition proceedings and pass appropriate order in accordance with law within a outer limit of 45 days. It is made clear that this petition is being decided only on the basis of averments made by the petitioner. 5.
It is made clear the this Court has not made any opinion in the merits of this case and the authority concerned are at liberty to pass appropriate orders in accordance with law after taking due care of the documents filed by the petitioner. 6.
