GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a writ or direction more particularly one in the nature of Writ of Mandamus declaring the actions of the respondent No. 3, 4 and their 2 staff in calling the petitioner to the 5th respondent P S demanding payment of Rs 4,00,000/ to the 5th respondent as per the compromise agreement dated 04.07.2025 insisting on foregoing the gold items to be returned by the 5th respondent harassing the petitioners family including his physically challenged father at the behest of 5th and 6threspondents as illegal arbitrary unconstitutional and consequently direct the respondent No 3 4 and their staff not to interfere with the life and liberty of the petitioner by calling him or his family members to the 3rd respondent police station without following due process of law or make such illegal demands for enforcement of the civil compromise agreement while directing the 2nd respondent to take departmental action against the erring officials.” 2. Sri Md.Farooq, learned Assistant Government Pleader for Home, on written instructions, would submit that, based on the complaint given by respondent No. 5, the police called both parties for preliminary enquiry and family counseling. 3. For ready reference, the written instructions are extracted hereunder: “It is further submitted that, the both parties were appeared before the Station House Officer, Muppalla PS for preliminary enquiry and family counseling. Further they stated that they will settle the matter before their elders. It is further submitted that, as the matter is purely related to the matrimonial disputes, the 4th respondent called the petitioner for 2nd time family counseling. But the petitioner did not turn up to the 4th Respondent police station and choose to file the present writ petition.” 4. Learned counsel for the petitioners would submit that the Court may pass appropriate orders. 5. In that view, the Writ Petition is disposed of. However, the police are directed not to interfere in the matrimonial disputes between the parties. Except for family counseling, police are further directed not to insist the petitioner for making financial settlement between the couple.
