It is the specific case of the petitioners that the said land is classified as Ziroyti land which was originally owned by one Sri Pyda Suryanarayana Murthy. Later, the said land was developed into a layout which was approved by the Director of Town and Country Planning vide DTCP Layout No.548 of 1984. Be that as it may. The said Suryanarayana Murthy was declared as surplus land holder under the provisions of Andhra Pradesh Land Reforms (Ceiling on Agricultural Holdings) Act, 1973. It is stated that against the orders passed by the primary authority, the said Pyda Suryanarayana Murthy approached the Land Reforms Appellate Tribunal by filing an appeal. It is stated that the said appeal was allowed by setting aside the order passed by the primary authority where under the order passed by the primary authority was set aside. 2. It is not in dispute that initially, the subject land was declared as surplus land under Land Ceiling Act. Thereafter, the declarant filed an appeal before the Tribunal and the orders passed by the Primary authority was set aside by the Land Reforms Tribunal, in LRA.Nos.9 and 8 of 1983. 10. On perusal of the material filed along with the writ petition, it is clear that the State carried the matter in revisions before this Court and the same was dismissed by order dated 02.09.1985 in C.R.P.No.2710 and 2711 of 1985. Later, the orders passed by this Court was also confirmed by the Hon’ble Apex Court by an order dated 03.02.1995 in S.L.P.No.1126 and 1127 of 1985. From the above, it is clear that the LCC case in respect of subject land attained finality way back in the year 1995. Despite the same, the respondents included the subject land in prohibited properties list without verifying the factual matrix of the case. Apart from the same, learned counsel for the petitioners places reliance on various communications and permissions accorded by respondent No.2 whose under similarly situated persons like that of the petitioners were permitted to alienate their respective plots. In view of the same, the plots were alienated without raising any objection by the respondents. 11. 12. Learned Assistant Government Pleader for Revenue submits that counter affidavit is filed by respondent No.2 stating that in view of the pendency of proceedings under the Land Ceiling Act, the property was rightly included under prohibited properties list. The said contention of the respondents cannot be countenanced in view of the fact that the litigation attained finality way back in the year 1995, before the Hon'ble Apex Court. 13. Having regard to the submissions made by the learned counsel for vide REV-ESEC0LAS(NOC)/101/ of respondent No.2 does not stand petitioners, the impugned endorsement 2019-SA(E5) - COL-EG dated 31.08.2019 for judicial scrutiny.
