JUSTICE LALITHA KANNEGANTI ORAL ORDER The writ petition is filed seeking mandamus to the IV Addl. Family Judge, Bengaluru for earlier disposal of I.A.No.4 pending under Section 24 of Hindu Marriage Act. 2. When an I.A. is filed a year ago and no orders are passed, this Court had called for a report from the IV Addl. Principal Judge, Family Court, Bengaluru as to why I.A. is not disposed of. A report is placed before this Court. It is stated that the present officer has taken charge recently and from the records, the matter was going on from 08.04.2024. On perusal of the report reveals that whenever the husband had sought time the adjournments were granted liberally and for that reason this application was not disposed of. Learned Judge in the report has also given the number of cases that are pending before the Court. 3. This Court is conscious of the cases that are pending before the Family Courts at Bengaluru and this Court - 3 - HC-KAR NC: 2025:KHC:22703 WP No. 18263 of 2025 do not expect the officers to do something that is not humanly possible, but at the same time there is a manner in which the applications have to be heard and disposed of. There should be a timeline for deciding the applications and there should be a reasonable time for filing the objections. If on every hearing the party asks for an adjournment the Court is not obligated to accept the said request and within the fixed time frame if the objections are not filed, the Court shall pass orders as per the material available on record. If in this manner the Courts keep on adjourning the matter there will be no end to the litigation and the party who do not want to proceed with the matter will forever seek adjournments. The whole purport of filing an interlocutory application for interim maintenance is to take care of the requirements of the party pending disposal of the main petition. Hence, this Court deems it appropriate to pass the following: ORDER i. The I.A. seeking interim maintenance shall be disposed of within a period of one month from - 4 - HC-KAR NC: 2025:KHC:22703 WP No. 18263 of 2025 the date of receipt of copy of the order. Unnecessary adjournments shall not be granted. ii. This Court is not proposing to issue notice to the respondent as disposal of a case is in the interest of both the parties. iii. Accordingly, the writ petition is disposed of. iv. All I.As. in the writ petition shall stand closed. SD/- (LALITHA KANNEGANTI) JUDGE BN List No.: 1 Sl No.: 16
