The petitioners who are agriculturists of village Pataras, Tahsil Dantewada, District Dantewada, preferred the present writ petition seeking a direction towards the respondents for payment of compensation as some part of their agricultural land bearing Khasra Nos. 65/1 and 65/14 has been utilized by the respondent authorities for construction of a by-pass road from Jawanga in Geedam to Gumda via Balpet and Balud. 2. Learned Counsel appearing for the petitioners submits that the 90% of the said by-pass road has already been constructed however, no compensation has been paid to the petitioners till date. 3. Learned counsel appearing for the respondents/State submits that if the land of the petitioners has been used or utilized for construction of by-pass road, the concerned Collector will make a 3 / 3 spot inspection and verify the said fact and necessary steps shall be taken for payment of compensation in accordance with law. 4. I have heard learned counsel for the parties and perused the pleadings of the petitioners. 5. From perusal of the pleadings, it appears that the by-pass road has been constructed by the respondent authorities and the land of the petitioners situated in village Pataras has been utilized by the respondent authorities. 6. In view of the above, the petitioners are directed to approach before the concerned Collector alongwith a copy of this writ petition within a period of 15 days from the date of receipt of a copy of this order. Further it is directed that the concerned Collector shall look into the matter and take appropriate steps within a period of 30 days to demarcate the land and on such demarcation, if it is found that the private land of the petitioners has been occupied by the respondent authorities for construction of by-pass road, ensure payment of proper compensation to the petitioners, who are agriculturists, in accordance with law. 7.
