In view of the order which is being proposed to be passed, notice is not being issued to the opposite party No. 2. 3. The sole prayer made in the present application is for disposal of the Criminal Revision No. 359 of 2023 (Sachin Jain Vs. State of U.P. and others), arising out of Complaint Case No. 31409 of 2023, under Section 138 of N.I. Act, P.S. Civil Lines, District Moradabad which has been filed by the opposite party No. 2 against the summoning order dated 28.08.2023. 4. Learned counsel for the applicant submits that despite the fact that the proceedings are pending but the same has not given a logical end. 5. Learned AGA has no objection to the same. 6. Considering the submission raised at bar, the application stands disposed of requiring the court below to expeditiously decide the proceedings strictly in accordance with law without granting unnecessary adjournments and, in case, any adjournment is granted then the same should be in exceptional circumstances in this regard, subject to legal impediment, if any.
