06/28.07.2025 The present writ petition has been filed for issuance of direction upon the respondent No.3 to issue the Land Possession Certificate to the petitioners with respect to the lands appertaining to Jamabandi No. 5/3433(A), Town Plan Plot No. 206 (Settlement Plot Nos. 30, 32, 72 & 78), measuring an area of 0.35 Acre; Jamabandi No. 5/3433(B), Town Plan Plot No. 206 (Settlement Plot Nos. 30, 32, 72 & 78), measuring an area of 0.27 Acre, Mouza-Ranga, P.S. No. 417, P.S-Deoghar, District-Deoghar. 2. Learned counsel for the petitioners submits that the petitoner No.1 had purchased the said land measuring an area of 0.35 Acre by virtue of registered sale deed No. 2952 dated 23.08.1983 whereas the petitioner No.2 had purchased the said land measuring an area of 0.27 Acre by virtue of registered sale deed No. 2953 dated 23.08.1983 from the vendor-Smt. Ginni Devi Sharma, wife of Sri Madan Mohan Sharma. Thereafter, the said lands were mutated and the rent receipts were issued in their favour. The grievance of the petitioners is that though they have applied for issuance of the Land Possession Certificate in their favour, however, the same has not been issued to them till date. 2025:JHHC:20698
3. Mr. K. K. Singh, learned S.C-V appearing on behalf of the respondents, submits that if the petitioners prefer a fresh representation in this regard before the respondent No.3, an appropriate decision/step will be taken by the said respondent within a time frame. 4. Having heard learned counsel for the parties and keeping in view the nature of the prayer made in the present writ petition, without entering into the merit of the case, the petitioners are given liberty to prefer a fresh representation before the respondent No.3 for issuance of the Land Possession Certificate in their favour with respect to the lands in question.
On receipt of the said representation, the respondent No.3, after calling for the relevant records and on providing an opportunity of hearing to the petitioners/their representatives, shall take an appropriate decision/step within eight weeks from the date of filing of the said representation. 5. The present writ petition is accordingly disposed of with the aforesaid liberty and direction. Satish/-
