THIS WRIT PETITION FILED UNDER ARTICLES 226 AND 227 OF THE CONSTITUTION OF INDIA PRAYING TO QUASH THE
ORDER DATED 18.08.2016 ISSUED BY R-3 AT ANNEX-A;
THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN 'B' GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR JUSTICE N S SANJAY GOWDA
ORAL ORDER The petitioner is challenging the notice dated 18.08.2016, whereby the BBMP is demanding a sum of Rs.6,45,498/- from the petitioner on the ground that the petitioner had erected an Advertisement Hoarding and displayed the advertisement illegally. The BBMP claims a sum of Rs.2,96,100/- as annual charges and a likesum towards penalty and a further sum of Rs.53,298/- as interest.
2. This court, while entertaining the writ petition, had directed the petitioner to deposit the annual charges

of Rs.2,96,100/-, and the petitioner has accordingly complied with the said condition.
3. In my view, since the impugned notice does not indicate that the petitioner was heard in the matter before the notice was issued, it would be appropriate to direct the petitioner to consider the impugned notice dated 18.8.2016 as a show cause notice and file objections within a period of three weeks from today. On such objections being filed, the concerned officer shall consider the same and pass appropriate orders after hearing the petitioner.
4. Accordingly, the writ petition is disposed of.
5. All contentions of the parties are left open.
