Faruque Ansari, Advocate For the State : Mr. Satish Prasad, Addl.P.P ------ Order No.03 Dated- 02-01-2025 Heard the parties. Apprehending their arrest in connection with Pakur (Town) P.S. Case No.201 of 2024 instituted under Sections 191(2), 191(3), 126(2), 127(2), 115(2), 109, 132, 324, 352, 351(2), 351(3) of the Indian Penal Code, the petitioners have moved this Court for grant of privileges of anticipatory bail. Learned counsel for the petitioners submits that the allegation against the petitioners is that the petitioners being members of mob attacked the doctors and health workers of Sadar Hospital, Pakur consequent upon death of a patient. It is next submitted that the allegation against the petitioner is false. It is also submitted that co-accused person with similar allegation have already been given the privileges of anticipatory bail by the Co-ordinate Bench of this Court vide order dated 25.11.2024 passed in A.B.A. No.6825 of 2024 and order dated 02.12.2024 passed in A.B.A. No.7173 of 2024. It is further submitted that the petitioners are not named in the FIR and their name transpired in the restatement of the informant. It is furthermore submitted that the case of the petitioners stands in a better footing than the co-accused persons who have been given the privileges of anticipatory bail. It is lastly submitted that the petitioners are ready and willing to co-operate with the investigation of the case and to furnish sufficient security including cash security. Hence, it is submitted that the petitioner be given the privileges of anticipatory bail. Learned Addl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner. Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioners. Accordingly, the petitioners are directed to surrender in the Court below within six weeks from today and in the event of their arrest or surrendering, they will be enlarged on bail on depositing Rs.5,000/- each as cash security and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Pakur in connection with Pakur (Town) P.S. Case No.201 of 2024 with the condition that they will co-operate with the investigation of the case and further conditions as laid down under Sections 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
