Petitioner has been made an accused in connection with S.T. Case No. 192/2024, arising out of Bariatu P.S. Case No.175 of 2023 registered for the offence under Sections 302, 120B, 34 IPC and Sections 25(1-B)a, 27, 35 of the Arms Act., charge has been framed under sections 302/34 and 120B IPC and section 25(1- A)26/27 of the Arms Act, pending in the Court of learned A.J.C.- III, Ranchi.
On 06.06.2023, at about 6:00 P.M., son of the informant, namely Tanvir Ahmad was shot dead by unknown persons. Suspicion has been raised against the accused persons and petitioner that they might have committed the murder of the deceased. After more than two months from the occurrence statement of one Pritam Kumar Singh has been recorded in which he has stated that the petitioner and co-accused persons had fired at the deceased.
Learned lawyer for the petitioner submitted that prosecution has not been able to explain the delay as to why this witness has kept silent for two months. It was further submitted. that Pritam Kumar Singh has instituted one criminal case prior to this occurrence against the petitioner.
Regard being had to the facts and circumstance of the
case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned A.J.C.-III, Ranchi in connection with S.T. Case No. 192/2024, arising out of Bariatu P.S. Case No.175 of 2023.
