JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 2 21-04-2025 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail application with regard to petitioner No. 1. 2. Permission is granted. 3. This anticipatory bail application with regard to petitioner No. 1 is, accordingly, dismissed as withdrawn. 4. Heard learned counsel for the petitioners and the State. 5. Petitioner No. 1 apprehends arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 448, 341, 323, 307, 354, 379, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R., allegation against petitioner is that he along with other F.I.R. named accused persons came to the house of informant on 19.06.2024 and started misbehaving with female members of the family and when informant protested, the accused persons returned back again at about 11:40 PM and started abusing in filthy language. Co-accused Pancha Rai fired bullet which hit on the leg of brother of the informant and co- accused Rohit Kumar fired bullet which hit on the leg of grandson of informant. It is further alleged that this petitioner snatched gold sikari from the neck of Manju Devi. 7. Learned counsel for the petitioner submits that both parties are co-villagers and next-door neighbours and due to petty dispute, this false and concocted case has been lodged. There is no specific allegation of overt act against this petitioner. Rest of the allegations are super addition. 8. Learned A.P.P. for the State vehemently opposed the bail application. 9. Considering the nature of accusation, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten Patna High Court CR. MISC. No.20223 of 2025(2) dt.21-04-2025 3/3 thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Samastipur in connection with Mohanpur P. S.
