This is misconceived petition. Petitioner wants this Court to issue a direction for release of his bank account no. 26990500003092 of Bank of Baroda (Vijaya Bank) Branch, Roza Mandi, District Shahjahanpur. According to the petitioner, without any justifiable cause, the account has been seized. Learned counsel for the Bank points out that in the account concerned, cash credit limit was availed and due to default in its repayment, the account has been declared NPA, whereafter various steps under the SARFAESI Act has been taken. Today, is the date of auction of the property. Since, the petitioner has withheld all such facts, we do not appreciate the filing of the writ petition, even otherwise the remedy of the petitioner would be before the Debt Recovery Tribunal, under Section 17 of the SARFAESI Act.
