ORAL ORDER
1. Accused in Crime No.321/2025 registered by K.R.Puram Police Station, Bengaluru City, for the offences punishable under Sections 80, 85 of BNS, 2023, and Sections 3 & 4 of Dowry Prohibition Act, 1961, is before this Court under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.321/2025 was registered by K.R.Puram Police Station, Bengaluru City, based on the first information dated 22.04.2025 received from Meenakshi - mother of deceased Lavya. During the course of investigation of the case, petitioner was arrested on 24.04.2025 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.4003/2025 was rejected on
09.06.2025. Therefore, petitioner is before this Court. 4. Perusal of the material on record would go to show that marriage of the petitioner with deceased Lavya was solemnized on 28.03.2018 and it appears that the couple had no children from the wedlock. It is alleged that the petitioner was abusing and ill-treating his wife on the ground that she had not given

birth to a child. Lavya had committed suicide by hanging herself in her matrimonial home on 21.04.2025.
Since the mother of the deceased suspected that the petitioner and his family members would have ill-treated the deceased in furtherance of their demand for dowry, she had approached the police and based on her first information, FIR was registered against the petitioner and his family members. After completing investigation, charge sheet has been filed against the petitioner for the aforesaid offences. The postmortem of the deceased would go to show that death was due to asphyxia because of hanging. Petitioner who has no other criminal antecedents is in custody from 24.04.2025. Investigation of the case is completed and charge sheet has been filed. Considering the aforesaid aspects of the matter, I am of the opinion that petitioner's prayer for grant of regular bail is required to be answered affirmatively. Accordingly, the following order:
5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.321/2025 registered by K.R.Puram Police Station, Bengaluru City, for the offences punishable under Sections 80, 85 of BNS, 2023, and Sections 3 & 4 of

Dowry Prohibition Act, 1961, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court;
b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons;
c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses;
d) The petitioner shall not involve in similar offences in future;
e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. Sd/- (S VISHWAJITH SHETTY) JUDGE
