Heard the parties.
Apprehending their arrest in connection with Complaint Case No.606 of 2016 instituted under Sections 33 of the Indian Forest Act, the petitioners have moved this Court for grant of privileges of anticipatory bail.
Learned counsel for the petitioners submits that the petitioners do not press the instant anticipatory bail application in respect of the petitioner No.2 namely Ranvijay Singh.
Accordingly, this anticipatory bail application stands rejected as not pressed in respect of the petitioner No.2 namely Ranvijay Singh.
So far as the petitioner No.1 namely Manoj Kumar Singh is concerned,
learned counsel appearing for the petitioners submits that the allegation against the petitioner No.1 namely Manoj Kumar Singh is that he was involved in commission of theft of stone boulders from forest area and by destroying the saplings and trees caused a loss of Rs.34,500/-. It is submitted that the allegation against the petitioner No.1 namely Manoj Kumar Singh is false. Drawing attention of this Court towards para-12 of the instant bail application, learned counsel for the petitioners submits that the petitioner No.1 namely Manoj Kumar Singh has no criminal antecedent. It is lastly submitted that the petitioner No.1 namely Manoj Kumar Singh undertakes to
co-operate with the trial of the case and to deposit Rs.34,500/- with the D.F.O, Wild Life Division, Hazaribagh without prejudice to his defence in this case subject to final decision of the case. Hence, it is submitted that the petitioner No.1 namely Manoj Kumar Singh be given the privileges of anticipatory bail.
Learned Spl.P.P appearing for the State opposes the prayer for anticipatory bail of the petitioner No.1 namely Manoj Kumar Singh.
Considering the submissions of learned counsels and the facts and circumstances stated above, I am inclined to grant privileges of anticipatory bail to the petitioner No.1 namely Manoj Kumar Singh. Accordingly, the petitioner No.1 namely Manoj Kumar Singh is directed to surrender in the Court below within eight weeks from today and in the event of his arrest or surrendering, he will be enlarged on bail on showing proof of depositing Rs.34,500/- with the D.F.O, Wild Life Division, Hazaribagh and on furnishing bail bond of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Chatra in connection with Complaint Case No.606 of 2016 with the condition that he will co-operate with the trial of the case and further conditions as laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
In case the petitioner No.1 namely Manoj Kumar Singh deposits Rs.34,500/- with the D.F.O, Wild Life Division, Hazaribagh, learned court below will pass appropriate order regarding the same at the time of conclusion of trial.
