The present writ petition has been filed, inter alia, seeking directions to the respondent no. 1, i.e., New Delhi Municipal Corporation (“NDMC”), to forthwith decide the petitioner’s pending applications for grant of sanction of additional Floor Area Ratio (“FAR”) in respect of the property bearing plot no. 159, 10 Bhagwan Dass Road, New Delhi (White House Apartments), in accordance with the applicable law, rules and policies. 2. Learned counsel for the petitioner points out that despite the representations of the petitioner with regard to grant of sanction for additional FAR, the said representations of the petitioner have not been This is a digitally signed order. Learned counsel for the petitioner submits that at this stage, the petitioner shall be satisfied if the representation of the petitioner can be considered in this regard. 4. Learned counsel for the respondent no. 1-NDMC submits that considering the fact that the representations submitted by the petitioner are old, the petitioner may be directed to file a fresh representation, which shall be decided by the NDMC. 5. Having heard learned counsels for the parties, and considering the submissions made by learned counsel for the petitioner that his representation with regard to grant of sanction of additional FAR in respect to the property in question, be decided, it is directed that the present petition be treated as a representation to the respondent-NDMC. 6. The respondent-NDMC is directed to decide the representation of the petitioner expeditiously, preferably, within a period of three months, from today. 7. At the time of considering the representation of the petitioner, the petitioner through himself or his authorized representative, shall be granted an opportunity of personal hearing. 8. The petitioner shall also be at liberty to file any documents as may be required, at the time of hearing of the representation of the petitioner. 9. The decision in the representation of the petitioner shall be duly communicated to the petitioner. In case, the petitioner is aggrieved by any order passed by the respondent no. 1-NDMC, the petitioner shall be at liberty to seek his remedies, in accordance with law.
