05/ 02.07.2025: Heard, learned counsel for the petitioner and learned counsel for the State.

This is an application filed by the petitioner praying for grant of anticipatory bail in terms of under Sections 482 and 484 of the Bhartiya Nagrik Surksha Sanhita, 2023, apprehending his arrest for offences under Sections 363/367/370/376D/34 of IPC, Section 4/8 of POCSO and Section 4/5 of Immoral Trafficking (Prevention) Act, 1956.

Learned counsel for the petitioner submits that process under Section 82 of Cr.P.C. has been quashed. Thus, this anticipatory bail application is maintainable.
4. The learned APP opposes the prayer for anticipatory bail.
5. After hearing the parties, I find that petitioner has taken 15 years old girl to Delhi and thereafter handed her over to someone else where she was made to work.
6. Considering the nature of allegation, I find that this is not a fit case for grant of anticipatory bail to the petitioner.
7. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Netarhaat P.S. Case No.03 of 2018 (Special POCSO Case No.18 of 2018), pending in the Court of learned Additional Sessions cum
Special Judge, Latehar, stands rejected.
8. If the petitioner appears before the Court concerned, his case will be considered on its own merit, especially considering the overt act alleged against the petitioner and considering the status of other accused persons.
