THIS REVIEW PETITION IS FILED UNDER SECTION 114 OF CPC R/W ORDER 47 RULE 1 OF CODE OF CIVIL PROCEDURE 1908 PRAYING TO MODIFY THE ORDER AS PRAYED FOR IN THE CALCULATION AS PER ANNEXURE C, IN INTEREST OF JUSTICE AND EQUITY.
THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM:
HON'BLE MR JUSTICE HEMANT CHANDANGOUDAR ORAL ORDER
1. This review petition is filed on the limited ground concerning the applicable rate of interest. While the order under review (at paragraph 7) had fixed the interest at 8% per annum, finding that imposing interest at 13.5 % on the petitioner is excessive. Accordingly,it was ordered that the petitioner shall pay interest at the reduced rate of 8% per annum on the belated payment.
2. The Court finds no error apparent on the face of the record warranting interference.
3. Accordingly, the petition stands disposed of with the clarification that this order is passed having regard to the peculiar facts and circumstances of the case, and the same shall not be treated as a precedent for future cases. Sd/- (HEMANT CHANDANGOUDAR) JUDGE
