Accused in Crime No.71/2025 registered by Vijayanagara Police Station, Mysuru City, for the offences punishable under Sections 351(1), 352, 353(2) of BNS, 2023 is before this Court under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.71/2025 was registered by Vijayanagara Police Station, Mysuru City, for the aforesaid offences against the petitioner herein, based on the first information dated 09.05.2025 received from Sri Satharga N K, Police Officer attached to Vijayanagar Police Station, Mysuru. During the course of investigation, petitioner herein was arrested on 09.05.2025 and subsequently, remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.734/2025 was rejected on 05.06.2025. Therefore, he is before this Court. 4. Petitioner, who is a government servant is in custody for the last two months. Major portion of the investigation in the - 3 - HC-KAR NC: 2025:KHC:25567 CRL.P No. 8578 of 2025 case is completed. The maximum punishment for the alleged offences is imprisonment for a period of three years. Under the circumstances, I am of the opinion that petitioner’s detention in custody is no more required. Accordingly, the following order:- 5. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.71/2025 registered by Vijayanagar Police Station, Mysuru City, for the offences punishable under Sections 353(2), 352 and 351(1) of BNS, 2023 subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 4 - HC-KAR NC: 2025:KHC:25567 CRL.P No. 8578 of 2025 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
