In Re.:CAN 1 of 2025 This is an application of modification/recalling of order dated 11th of August, 2025 passed by this Court in WPA 14098 OF 2025 Mr. Swapan Kr. Datta, learned AGP appears on behalf of State submits that the petitioner was not present on 11th of August, 2025. But, one instruction was received from the department. On the basis of which, a submission was made on behalf of the state respondent. Mr. Datta frankly submits that the instruction pertains to another matter of the same petitioner. Mr. Datta further submits that on the basis of the said instruction the writ petition was disposed of 2 and he has no objection, if the writ petition be revived which was only dismissed on the basis of wrong instruction. Having heard the learned counsel for the petitioner as well as submissions made on behalf of the State respondent, the order passed by this Court on 11th of August, 2025 is herby recalled. The application being CAN 1 of 2025 be allowed and disposed of. WPA 14098 of 2025 is herby restored to its original file and number. Let the matter appear in the list under the heading “New Motion”.
